C. §1155 based on a sham-marriage determination by the Secretary of Homeland Security is the kind of discretionary decision that falls within the purview of §1252(a)(2)(B)(ii), which strips federal courts of jurisdiction to review certain actions “in the discretion of ” the agency.

A Legacy of Inclusion—President Carter and the Federal Judiciary


Serving only one term, the late President James “Jimmy” Carter did not have the opportunity to nominate a Supreme Court Justice. His other judicial nominations, however, impacted the federal judiciary over his four years in office and beyond. Making a commitment to selecting qualified women and minorities to create a more diverse judiciary, President Carter appointed over 260 individuals to the federal district courts and courts of appeals. Two of President Carter’s courts of appeals appointments, Ruth Bader Ginsburg and Stephen G. Breyer, would go on to join the Supreme Court in 1993 and 1994, respectively.
