  • The Court will convene for a public session in the Courtroom at 10 a.m. The Justices will hear two oral arguments. An audio feed will be live-streamed, and the audio will be available on the Court's website later in the day.
  • Seating for the oral argument session will be provided to the public, members of the Supreme Court Bar, and press. The three-minute line will be temporarily suspended. The Supreme Court Building will be otherwise closed to the public.
  • The Supreme Court Building will reopen to the public following the conclusion of the Court session and close at 3 p.m.

Hamm v. Smith (23-167) (Per Curiam)
The judgment is vacated and the case is remanded to the Eleventh Circuit to clarify the basis for its decision affirming the District Court’s judgment that Smith is ineligible for the death penalty due to intellectual disability.

November Oaths


Of the 116 Supreme Court Justices, only two took their Judicial Oath in the month of November—and it has not happened in over 200 years. The first, Bushrod Washington, assumed the seat of his former legal tutor, Justice James Wilson, on November 9, 1798. Justice Washington served until his death on November 26, 1829. The second, Gabriel Duvall, took his oath on November 23, 1811, shortly before his 59th birthday. Justice Duvall served for almost a quarter century before resigning on January 14, 1835.
