The Eight-Man Court of October Term 1906

When the Supreme Court began its Term on Monday, October 8, 1906, it did so before the seat of recently retired Justice Henry B. Brown had been filled. Photographer Barnett M. Clinedinst, Jr., known for his innovative photo-illustration techniques, was ready with a montage of the eight Justices ascending the Bench, which he distributed to newspapers. This is the only known image of the Justices doing so, as well as the only known contemporary photograph depicting an incomplete Court.

Clinedinst’s “Opening of U.S. Supreme Court” depicts from right to left, by seniority: Chief Justice Melville W. Fuller, and Associate Justices John Marshall Harlan, David J. Brewer, Edward D. White, Rufus W. Peckham, Joseph McKenna, William R. Day, and Oliver Wendell Holmes, Jr.

Clinedinst’s montage appeared in some newspapers on October 8, which means he had sent it out well in advance. In some, like this engraved version that appeared in the Kansas City Star, readers may have seen it before the event actually took place in Washington, D.C.

Quick to adapt, Clinedinst added Justice William H. Moody (far left) to his montage after Moody joined the Court on December 17, 1906. The Washington Post, and perhaps other newspapers, published this second version soon thereafter.
